The court emphasized that any last-minute changes would lead to chaos and injustice for the candidates.

A division bench comprising Justices MC Tripathi and AK Gupta, however, clarified that the declaration of results shall remain subject to the outcome of the special appeal filed by UPPSC.

The bench noted,
“We find that the writ petitions preferred by about 50 petitioners have been allowed by the learned single judge vide impugned judgment and order dated September 25, 2025, with direction to the Commission to redraw the list.”

“At this stage, as the examination is scheduled for September 28, 2025, and more than 7,000 candidates will be appearing, any disturbance in the examination at this eleventh hour will cause great chaos and injustice to the candidates.”

Earlier, a single bench had ordered UPPSC to revise its preliminary examination results for the 2024 Combined State Engineering Services recruitment. The bench held that the principle of migration applies even at the stage of preliminary or screening tests.

The preliminary examination was conducted earlier this year, with results declared on May 26. For 609 posts, only 7,358 candidates were shortlisted for the mains examination. However, Clause 11(8) of the official advertisement required 15 times the number of vacancies—9,135 candidates—to be declared qualified.

### Reservation and Migration Issue

Candidates from reserved categories raised concerns before the single judge regarding UPPSC’s method of publishing results strictly category-wise. They argued that this approach unfairly excluded many meritorious candidates belonging to OBC, SC, and ST communities who scored higher than the last selected unreserved candidate but were not counted in the open list.

They contended that the unreserved category is not a “reservation quota” and should remain open to all candidates. By limiting migration only to the final selection stage, the commission allegedly denied equal opportunity at the very initial stage of recruitment.

This order by the single bench was challenged before the division bench through a special appeal, which is currently pending.
