**NIA Moves Special Court to Impound Passports of Accused in Elgar Parishad Case**
Mumbai: Years after arresting the accused in connection with the Elgar Parishad case, the National Investigation Agency (NIA) has now approached a special court seeking to impound their passports for a specified period.
On Monday, Special Public Prosecutor Prakash Shetty filed a plea requesting the impounding of passports belonging to five accused individuals — Rona Wilson, Mahesh Raut, Anand Teltumbde, Gautam Navlakha, and Hany Babu. The court is expected to hear the plea on October 9.
**Legal Basis for the Plea**
The plea has been filed under Section 51 of the Criminal Procedure Code (CrPC), which states that the passport of a person chargesheeted under the Unlawful Activities (Prevention) Act (UAPA) is deemed to be impounded. However, the duration for which the passport remains impounded must be determined by the court. In line with this provision, the prosecution has approached the special court to decide the period for impounding the passports of the accused.
**Reason for the Action**
According to the prosecution, Anand Teltumbde delivered a “provocative presentation” and speeches on December 31, 2017, during an event at Shaniwarwada. This is alleged to have contributed to the violence at Bhima-Koregaon in January 2018, which triggered state-wide agitation and resulted in loss of life.
The NIA’s move to impound passports is aimed at preventing the accused from fleeing the country while the investigation and trial are ongoing.
