Mumbai: Maharashtra to Introduce New Law to Regulate Diagnostic Laboratories

State Health Minister Prakash Abitkar has announced that the Maharashtra government will introduce a new law in the upcoming winter legislative session aimed at regulating diagnostic laboratories across the state. The proposed legislation seeks to establish clear standards for laboratories, ensure proper monitoring, and empower authorities to take strict action against those that fail to comply.

Addressing Inconsistent Test Results

Minister Abitkar highlighted a pressing concern in the healthcare sector: often, the same sample tested at different laboratories yields varying results. This inconsistency can lead to incorrect diagnoses and inappropriate treatments for patients.

To tackle this issue, the new law will mandate that every diagnostic lab employs qualified staff and utilizes standardized machinery. Additionally, a dedicated monitoring authority will be established to oversee laboratory functions. In cases of discrepancies or negligence related to test results, strict punitive measures will be enforced.

Regulatory Gap in Maharashtra

Currently, Maharashtra lacks specific legislation regulating the operations of millions of diagnostic laboratories functioning throughout the state. There are no defined rules regarding the permissions labs must obtain, qualifications of specialists involved, necessary signatures on reports, staffing standards, or the machinery required.

Concerns Over Patient Safety

The absence of regulatory oversight has made it challenging for authorities to take action against labs operating without proper supervision. Many laboratories continue to function unchecked, raising serious concerns about the accuracy and reliability of diagnostic tests. This situation poses direct risks to patient safety and wellbeing.

Benefits of the New Law

Minister Abitkar emphasized that the new legislation will streamline diagnostic services and ensure that patients receive reliable and safe medical testing. Healthcare experts have welcomed this initiative, stating that establishing uniform standards for laboratories is essential to maintain public trust in medical diagnostics and protect patients.

Strengthening Healthcare Oversight

With this new legislation, Maharashtra aims to bridge a long-standing regulatory gap while strengthening healthcare monitoring mechanisms in the state. The law will promote accountability and enhance patient safety across Maharashtra.
